Terms of Service

Terms of Service are usually pretty long and boring and … well ... no fun.  We encourage you to read the entire thing, but we figure most people won’t.  So, we've colored the stuff we'd like you to pay special attention to in blue.

We just want you to know up front that what governs us personally is the Golden Rule.  We’ll try to treat you as we’d like to be treated, and we’ll try to have fun.  That’s just who we are.

Beginning Legal Stuff (the standard, boring stuff, but we've tried to make it understandable):
By using this website or our cleaning service, you agree to these Terms of Service and to our Privacy Policy, which is posted here on our website.  You agree that we can change these Terms of Service and our Privacy Policy without notice and that it's your responsibility to read and monitor them.  We reserve the right to refuse access to the service or our site to anyone for any reason at any time.  By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence.  You agree that we’re not attorneys, psychologists, or physicians, that we don’t dispense legal, psychological, or medical advice, and that if you need such advice, you should seek an appropriate professional.  We are not responsible if information made available on this site is not accurate, complete or current. You agree that if you or we terminate your use of the Service for any reason, you will not be entitled to any refunds or credit for used, unused, or partially used service.  If you don't agree to these Terms of Service or to our Privacy Policy, you agree to terminate your use of this site and our service.

Names:
We refer to The Wonder Maids LLC as "we," "us," "our," "service," "Maids," and "The Wonder Maids." We refer to the people or businesses that use our site or our services as "you," "your," and "yours."  We refer to TheWonderMaids.com as "site," "website," or "blog." 

About Smoking:
For the health of everyone, we are a strictly non-smoking cleaning service.  We do not clean the homes of smokers, regardless of whether they smoke inside or outside the home (and regardless of what they smoke).  If you hire us, that means you're asserting that no one who lives in your home is a smoker and that you won't allow guests to smoke inside your home.

About Pets:
Because one of us has asthma, we cannot work in homes that have pet rodents (rats, mice, guinea pigs, etc.) or pet snakes.  You agree to confine or place in a separate room excessively wary, anxious, or aggressive pets of any kind before we arrive and to leave a note about these pets' locations on your front door.  If you don't, it will count as a non-emergency cancellation, and we might charge you a cancellation fee.

Gift Certificates:
We reserve the right to limit the quantity of gift certificates sold and to refund gift certificate sales for any reason, without the obligation to provide service to the original purchaser or to the certificate's recipient.  Recipient must schedule service at least 1 month before the certificate's expiration date.  Service paid for with a gift certificate is not eligible for our satisfaction guarantee (though we will, of course, give the same great service we always do).  Gift certificates expire 6 months after purchase.  Unredeemed, expired gift certificates will not be refunded.

Referral Gifts:
We love giving referral gifts.  But like any other gift, we reserve the right to not give them for any reason (such as when we suspect fraud).  We always wait to give you your referral gift until 24 hours after the cleaning we've been referred to do is completed in accordance with our satisfaction guarantee.

Valuables:
You agree to secure extremely valuable belongings before we arrive and that we are not responsible for damage to items or collections worth over $5000.

Illness:
If anyone in your household is ill with a contagious disease, you agree to notify us as soon as possible so that we can reschedule your cleaning.

Cancellations:
Certain kinds of cancellations, such as cancellations given with less than 48 hours notice, may incur a cancellation fee up to the full amount due if we'd been able to complete your service.  That said, we understand that things happen, so your first cancellation each year is usually free, even if you don't give us notice.  If we arrive at your home to find violations of the Access, Children, Pets, or Smoking sections of these Terms, we count it as a cancellation.

Adverse Weather:
We may have to reschedule or even cancel cleanings when the weather isn't cooperating, and you agree to allow us to do so without penalty.  For instance, we may not service your home if the roads are icy, if the outside temperature is above 80 degrees and your home is not air conditioned, or if there's a thunderstorm.

Guarantee:
If for any reason you're unhappy with the cleaning we've done, notify us within 24 hours and give us a chance to correct the problem.  If we can't, we'll refund your money.  It's a simple as that.

Access:
You agree to provide us with access to your home at the agreed-upon time of our arrival.  Access includes necessary keys, key codes, alarm codes--or simply opening the door for us.  You also agree to give us what we need to safely lock up and secure your property when we leave.

Children:
You agree to restrict minors from entering the areas where we are cleaning and that minors must not be home by themselves at the time we're scheduled to be there.  You indemnify us and hold us harmless from any injuries to children that happen as a consequence of our presence or our cleaning activities and agree to supervise children while we are in your home.

Payment:
Before we clean your home the first time, we will give you an initial quote outlining what work is to be done and how much it will cost..  When we clean your home, we will perform all the cleaning tasks included in the quote.  You agree to pay us at least the amount of our initial quote each time we service your home.  Any extra tasks you ask us to do will take us more time and will be charged accordingly, at our normal rates.  Payment is due at the time of service.

Third Party Content:
We're not responsible or liable for any third-party links or content available from our site, and you agree that we're not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. 

Your Content:
You agree that we can use any content you transmit to us for any purpose.  You represent and warrant that you have the right to grant and assign to The Wonder Maids LLC a perpetual, irrevocable, unlimited, fully paid-for, fully sub-licensable (through multiple tiers), worldwide license to display, distribute, prepare derivative works from (including, without limitation, incorporating into other works) copy, perform, and otherwise use any content that you transmit to us or post to our site. We may, but have no obligation to, monitor, edit, or remove content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or that violates any party’s intellectual property or these Terms of Service. We take no responsibility and assume no liability for any information or comments posted by you or any third-party.

Ending Legal Stuff (more of the standard, boring stuff, but we've tried to make it understandable):
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.  The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.  These Terms of Service are effective unless and until terminated by either you or us.  You may terminate these Terms of Service at any time by notifying us that you no longer wish to use the site and service.  If in our sole judgment we suspect that you have failed to comply with any part of these Terms of Service, we may terminate this agreement and refuse service to you at any time without notice, and you will remain liable for all amounts due us, up to and including the date of termination.  The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.  Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party. These Terms of Service and any separate agreements whereby we provide or make accessible to you goods or services shall be governed by and construed in accordance with the laws of the United States of America and of the State of Washington. If a dispute arises between you and The Wonder Maids, both parties shall attempt, promptly and in good faith, to resolve any dispute.  If the parties are unable to resolve any such dispute within 30 days, then either party may submit the dispute for mediation.  If such mediation does not resolve the dispute within 60 days, the dispute can then only then be resolved by arbitration.  Such arbitration will be conducted by a professional arbitrator in King County, Washington, USA, or in any other convenient forum agreed to in writing by both parties.  Any arbitration will be conducted in accordance with standard Atlanta International Arbitration practices.  Any arbitration award shall be final and binding and may be entered in any court of proper jurisdiction.  You agree that if you bring a claim in court, the proceeding shall be filed and brought in King County, Washington, and you waive any objection to such jurisdiction or venue.  You agree that you must request arbitration or bring a claim in court within one year after the dispute arises.  These Terms of Service and any policies or operating rules posted by us on the site or in respect to the service constitutes the entire agreement and understanding between you and us and governs your use of the site and our service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
